§ 70.01. LOADS SECURED ON VEHICLES.

  • (A) Any truck or trailer with a rated capacity of 1,000 pounds or more, and carrying a bulk load of coal or other mineral, grain, sand, gravel, crushed stone, fill dirt or any substance of comparable particle size and texture on public roads in the county shall have the load secured in a manner that will prevent dislodgement and scattering of any portion of the load upon a public road, the road right-of-way or any adjacent property.
    (B) No person or corporate entity who is a producer, shipper, broker, seller, purchaser, handler, owner or custodian of any material or vehicle subject to this section shall cause or permit any load to enter a public road from premises under its control, unless secured in compliance with division (A) above.
    (C) For purposes of this section, a manufactured lid or hatch cover, or a sheet or tarpaulin of canvas or other material of appropriate strength and integrity shall be deemed a sufficient cover when tightly fitted and secured to the truck or trailer so that it covers the entire load and remains in place throughout the haul.
    (D) The following shall be exempt from the provisions of divisions (A) and (B) above; provided, however, that, nothing in this section shall relieve any owner or operator of the necessity of securing transported materials so as to prevent their becoming a traffic hazard:
    (1) Agricultural commodities grown and harvested within the county, during transportation from the field to an initial point of sale or storage within the county;
    (2) Construction materials while transported to the point of final use from any place within the same job site, or from a mine, pit or stockpile within two miles of the job site;
    (3) Materials such as salt and sand intended to be spread on roads to improve traction for public travel in winter, when loaded upon a spreader-equipped vehicle operated by the appropriate road maintenance authority; and
    (4) Snow and ice, immediately following removal from any public or private road, driveway or parking area.
    (E) This section shall be effective from and after the date of its passage and publication as required by law.
